Terms and Conditions

1. DEPOSIT & CONTRACT: A non-refundable certified check of $10,000 per parcel made out to Perrysburg Title is required from the successful bidder(s) immediately at the conclusion of the auction. (e.g., 5 parcels = $50,000 deposit). Deposits must be in the form of a personal check, cashier's check, certified check, or wire transfer. The successful bidder must execute the Purchase Agreement immediately following the auction.

2. BUYER’S PREMIUM: A 10% Buyer’s Premium will be added to the high bid price to determine the Total Contract Price. Example: High Bid of $100,000 + 10% ($10,000) = $110,000 Total Contract Price.

3. "AS-IS" SALE: The property is being sold "As-Is, Where-Is" with all faults. This sale is NOT contingent upon financing, property condition, appraisal, or inspections. Selling all dirt/ground as AG dirt. Seller will not cover CAUV recoupment. 

4. BIDDING METHOD: Parcels will be offered individually and in combinations at the Auctioneer's discretion. The Auctioneer reserves the right to determine the bidding increments and the order of sale to best serve the Seller.

5. CLOSING: Closing shall occur within 30 days of the auction date. Seller shall provide a deed conveying marketable title. Perrysburg Title will be doing title work. 

6. BROKER PARTICIPATION: Compensation is available to any Ohio licensed real estate salesperson who properly registers a successful bidder.

  • Attendance Requirement: If a Broker or Salesperson represents an online bidder, the agent must still be present in person at the live auction event to represent their client’s interests and facilitate contract execution.
  • Registration: Realtor registration forms must be submitted 48 hours prior to the auction. No exceptions. Contact our office for the Realtor Participation Form. 

7. ONLINE BIDDING & DEFAULT:

  • Verification: Online bidders must be verified prior to the start of the auction.
  • Technical Issues: The Auction Company is not responsible for technology failures or missed bids.

8. ANNOUNCEMENTS: All announcements made the day of the auction take precedence over any previously printed material or oral statements.
